1. Acceptance of Terms

By accessing or using the Honey Badger application, website at badgerbot.net, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Honey Badger is a gift delivery platform that allows users to send gifts (such as gift cards, cash gifts, and personalized messages) to recipients. Recipients unlock their gifts by completing fun motivational challenges. The Service includes:

• Gift creation and delivery via SMS and email notifications
• Motivational challenge management and tracking
• Photo submission and approval workflows
• SMS and email-based notifications and reminders

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years of age to use the Service. By creating an account, you represent that you are at least 13 years old.

4. Sending Gifts

When you send a gift through Honey Badger:

• You are responsible for providing accurate recipient contact information (phone number and/or email)
• You confirm that you have a personal relationship with the recipient and believe they would welcome receiving the gift notification
• You understand that the recipient will receive SMS and/or email messages from Honey Badger about the gift
• You are responsible for the value and content of any gift cards or monetary gifts you attach
• Challenges you create must be safe, legal, and appropriate

5. SMS Messaging Terms

By using the Service, you acknowledge and agree to our SMS messaging practices:

• Gift recipients will receive transactional SMS messages related to their gift and challenge
• Message frequency varies based on gift and challenge settings (typically 1-5 messages per gift)
• Message and data rates may apply based on your carrier plan
• Recipients can opt out at any time by replying STOP
• Recipients can get help by replying HELP

6. User Content

"User Content" includes photos, messages, challenge descriptions, and any other content you submit through the Service. By submitting User Content, you:

• Represent that you own or have the right to share the content
• Grant Honey Badger a non-exclusive, royalty-free license to use, display, and transmit the content as necessary to operate the Service
• Agree not to submit content that is illegal, offensive, harassing, or violates the rights of others

We reserve the right to remove any User Content that violates these Terms.

7. Prohibited Uses

You agree not to use the Service to:

• Send gifts or messages to individuals who have not consented or who you do not personally know
• Harass, threaten, or intimidate any person
• Send spam, unsolicited messages, or use the Service for bulk messaging
• Create challenges that are dangerous, illegal, or inappropriate
• Impersonate any person or entity
• Attempt to gain unauthorized access to the Service or its systems
• Use the Service for any illegal purpose

8. Gift Cards and Monetary Gifts

Honey Badger facilitates the delivery of gifts but is not responsible for:

• The value or validity of third-party gift cards
• Redemption issues with gift cards or promotional codes
• Loss of gift value due to expiration or other third-party terms

Gifts are between the sender and recipient. Honey Badger serves as the notification and challenge platform only.

9. Intellectual Property

The Service, including its design, features, and content (excluding User Content), is owned by Honey Badger and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We disclaim all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Honey Badger shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately, but these Terms will continue to apply to any prior use.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by updating the "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
